Terms of Service

These Terms of Service ("Terms") govern your use of Aboundo (the "Service"), operated by Aboundo ("we," "us," or "our"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy, Data Processing Agreement, and Cookie Policy. If you access the Service under a signed Order Form, our Master Subscription Agreement also applies and controls over these Terms as to the commercial terms it addresses.

1. The Service

Aboundo provides a hosted lead-capture form platform. You ("Tenant" or "Customer") use the Service to build forms — including standard lead-capture forms and Gated Document forms, which distribute a file you upload in exchange for a visitor's contact information — collect lead submissions from your visitors, and integrate with third-party services such as Salesforce. Forms may be shared with visitors via a hosted URL, embedded directly on your own website, or both. We are a data processor; you are the data controller for all personal data collected through your forms.

2. Accounts and Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3. Acceptable Use

You may not use the Service to:

• Collect personal data without a lawful basis or without disclosing a privacy policy to your form visitors.
• Send spam or unsolicited communications using leads collected through the Service.
• Collect sensitive personal data (health, financial, government IDs) without appropriate consent and safeguards.
• Violate any applicable law, including data protection laws (GDPR, CCPA, and similar).
• Reverse-engineer, resell, or sublicense the Service.

4. Fees, Billing, and Plans

Pricing is organized by form type, each sold in blocks: standard (Core) forms are priced per block of five forms, and Gated Document forms are priced per block of two forms. Current pricing is displayed on the pricing page. Fees are billed monthly through our payment processor, Stripe, which collects and processes your payment details directly — we do not receive or store your full card number. Except as required by applicable law, fees already paid are non-refundable.

Submission limits. Each plan includes a monthly submission allowance based on the blocks you've purchased. Submissions received after your account reaches its allowance for the current billing cycle are still captured and stored — no lead is ever lost — but remain locked and unavailable in your dashboard, exports, and any connected integration (such as Salesforce) until you increase your plan or your next billing cycle begins, at which point previously locked submissions become available automatically. Accounts on a free trial are subject to a flat monthly submission allowance regardless of the blocks provisioned for the trial.

Free trials. We may offer free trial periods on certain plans, including self-serve trials, which require a valid payment method at signup and convert automatically to a paid subscription at the then-current rate when the trial ends unless you cancel before that date, and trials we arrange with you directly. Trial length and terms are as stated at signup or in the applicable trial offer. Trials are limited to one per customer, and we may deny or revoke a trial we reasonably believe is duplicative or abusive.

Non-payment. If a payment fails or your subscription otherwise lapses, we may suspend the Service, including automatically unpublishing your live forms so they become unavailable to visitors. Suspension for non-payment does not by itself delete your data or end this agreement — see Section 10 (Termination) and our Privacy Policy for data retention. Bringing your subscription current restores access to previously published forms with no further action required on your part.

Some accounts, including certain accounts we create directly, may be exempt from some or all of the billing terms in this Section at our discretion; where that is the case, we will tell you.

5. Data and Privacy

We process personal data on your behalf as described in the Data Processing Agreement. You retain ownership of all data collected through your forms. We do not sell your data or your visitors' data to third parties.

6. Third-Party Integrations

The Service supports integration with third-party platforms including Salesforce. When you enable an integration, data is transmitted to that third party under their terms and privacy policy. You are responsible for ensuring such transfers comply with applicable law.

7. Intellectual Property

We retain all rights in the Service, including its software, design, and documentation. You retain all rights in your content (form configurations, lead data).

8. Availability and SLA

We aim for high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranty of any kind, express or implied.

9. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising from or related to the Service shall not exceed the amounts paid by you in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate this agreement at any time. Suspension of the Service for non-payment (Section 4) is separate from termination — it does not by itself end this agreement or delete your data. On termination, your access to the Service ends. We will make your lead data available for export for 30 days after termination, after which it may be deleted, subject to the retention terms in our Privacy Policy.

11. Changes to These Terms

We may update these Terms. We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Aboundo is incorporated, without regard to conflict-of-law principles.

13. Gated Document Uploads — Acceptable Use

If you use the Service's Gated Document form type to distribute a file (e.g., a whitepaper, guide, or other downloadable content) in exchange for a visitor's contact information, the file you upload must not:

• Contain illegal content, or content that infringes any third party's intellectual property, privacy, or other rights.
• Violate any applicable law or regulation.
• Contain malware, viruses, or other harmful code.

We reserve the right to remove any uploaded document and suspend the associated account, without notice, if we reasonably believe it violates this policy. To report content you believe violates this policy, contact abuse@aboundo.example.
